1. Introduction
These Terms & Conditions ("Terms") govern your use of the MarketGenie website at marketgenie.uk and any web design, development, or related services we provide. By engaging our services or using this website, you agree to these Terms.

3. Services
We offer web design, web development, search engine optimisation, copywriting, and related digital marketing services. The specific services to be provided, deliverables, fees, and timelines for any engagement will be set out in a separate written proposal or statement of work agreed between us and the client.
4. Quotes and proposals
All quotes and proposals are valid for 30 days from the date of issue unless otherwise stated. Acceptance of a proposal constitutes a binding agreement to engage our services on the terms set out in that proposal and these Terms.
5. Payment
Unless otherwise agreed in writing, our standard payment terms are 50% deposit on commencement of work and the remaining 50% on completion before the site goes live. Invoices are payable within 14 days of issue. Late payments may incur interest at the statutory rate set by UK law.
6. Client responsibilities
To deliver projects on time and to a high standard, we rely on clients to:
- Provide accurate and complete information about their business and requirements
- Supply content (text, images, branding assets) in a timely manner
- Respond to communications and feedback requests within reasonable timeframes
- Pay invoices in accordance with our payment terms
Delays caused by the client may result in revised project timelines and, where applicable, additional fees.
7. Revisions and changes
Each project includes a defined number of revision rounds, as stated in the relevant proposal. Changes requested outside the agreed scope will be quoted separately and require written approval before work commences.
8. Intellectual property
On full payment of all fees due, ownership of the final deliverables (including code, design files, and content created specifically for the project) transfers to the client. We retain the right to showcase work in our portfolio and marketing materials unless otherwise agreed in writing.
Third-party assets (such as fonts, stock images, plugins, or libraries) are licensed to the client subject to the terms of the applicable licence and remain the property of their respective owners.
9. Cancellation and termination
Either party may terminate an engagement with reasonable written notice. Where work has been carried out prior to termination, the client is liable to pay for time and work completed up to the date of termination. Deposits are non-refundable.
10. Liability
We deliver our services with reasonable care and skill. However, to the fullest extent permitted by law, our total liability arising out of or in connection with any project shall not exceed the total fees paid by the client for that project. We are not liable for indirect, consequential, or special losses, including loss of profit, business, or data.
Nothing in these Terms limits or excludes liability that cannot legally be limited or excluded, such as liability for death or personal injury caused by negligence, or for fraud.
11. Confidentiality
We treat all client information as confidential and will not share it with third parties except as necessary to deliver the services (e.g. with hosting providers) or as required by law.
12. Hosting and third-party services
Where we recommend or arrange third-party services (hosting, domains, plugins, etc.) on the client's behalf, those services are subject to the terms of the relevant providers, and we are not responsible for their availability, performance, or pricing changes.
13. Data protection
Our handling of personal data is governed by our Privacy Policy.
14. Governing law
These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
15. Changes to these Terms
We may update these Terms from time to time. The most current version will always be available at this URL. Continued use of our services after changes are posted constitutes acceptance of the revised Terms.
